1About This Policy
This policy applies to everyone who uses Nichevio, including Account holders, team members, Profile owners and Visitors who submit forms, Orders or other requests through a Profile. It forms part of the Terms of Service, and its terms such as Profile, Visitor and Records have the meanings given there.
You are responsible for the content on Profiles you control and for what you and your team do in your Workspace. The examples below are not a complete list. We may act on content or activity that is clearly similar to them.
2The Basic Rules
- Follow the law that applies to you, to your business and to the people you deal with.
- Be truthful about who you are and what you offer.
- Respect other people’s rights, safety and privacy.
- Use the Service as it is designed to be used, within the limits of your Plan.
3Unlawful and Harmful Content
Do not publish, share or link to content that:
- is unlawful, or promotes or helps with unlawful activity;
- is obscene or pornographic, or invades another person’s bodily privacy;
- sexually exploits or endangers children, in any form;
- harasses, threatens, defames or intimidates anyone, or promotes violence against people or groups;
- insults or promotes hatred or discrimination against people based on religion, caste, ethnicity, nationality, gender, sexual orientation, disability or similar characteristics;
- promotes terrorism, violent extremism or self-harm;
- is knowingly false or misleading and could cause harm, including content made to look like it comes from a real person, business or authority when it does not;
- threatens public order or the security of a country; or
- promotes gambling or betting that is unlawful where it is offered.
Content that sexually exploits or endangers children is removed and reported to the authorities.
4Fraud and Deceptive Practices
Do not use Nichevio to deceive people. For example, do not:
- create a Profile for a business that does not exist, or that you do not represent;
- list goods or services you do not intend or are not able to provide;
- publish misleading prices, discounts, availability or conditions;
- publish fake reviews or testimonials, or present them as coming from real customers when they do not;
- claim certifications, licences, awards or affiliations you do not have; or
- take payments for an Order and then fail to deliver without a legitimate reason, or refuse refunds the law requires you to give.
5Impersonation and Misrepresentation
Do not pretend to be someone else, or suggest a connection that does not exist. This includes impersonating a person, a business, a brand, a public authority or Nichevio, and choosing a Profile address, name, logo or design that is likely to make Visitors believe they are dealing with someone else.
Representing a client or employer is allowed when you have their authority and the Profile does not mislead Visitors about who they are dealing with.
6Phishing and Requests for Sensitive Credentials
Do not use a Profile, form, Article, message or payment instruction to obtain sign-in or financial credentials. Never ask Visitors for:
- passwords or sign-in codes for any service;
- card numbers, card security codes or card PINs;
- UPI PINs, banking passwords or one-time passwords sent by a bank; or
- any other credential that would let someone else access their accounts.
Do not link to pages designed to collect such information, or to pages that imitate another service or Nichevio.
7Spam and Unwanted Messages
Do not:
- send messages to people who have not agreed to receive them, including by importing contacts as newsletter subscribers without their consent;
- use Records for purposes the Visitor would not expect from the form they submitted;
- keep emailing a subscriber after they have unsubscribed;
- submit forms, Orders or RFQs to other Profiles in bulk, automatically or under false details; or
- create Profiles or Articles mainly to manipulate search results or to promote unrelated links.
8Malware and Harmful Files
Do not upload, distribute or link to malware, spyware, ransomware, viruses, hidden cryptocurrency miners or any other code or file designed to damage, take over or gain unauthorised access to devices, accounts or systems.
9Intellectual Property
Publish only content you own or have permission to use. Do not:
- use text, images, music, video, designs, logos or trademarks that belong to others without permission or another legal basis;
- sell or promote counterfeit goods, or unauthorised copies of software or media; or
- remove or change copyright or ownership notices.
If you believe content on a Profile infringes your rights, use Report Abuse and include the Profile address, a description of your work and how the content infringes it.
10Privacy and Personal Information
Do not:
- publish another person’s private information, such as their home address, phone number, identity documents or financial details, without their permission;
- collect more personal information through a form than you need for its purpose, or collect sensitive information, such as health or financial details or government identity numbers, without a lawful reason and the notices the law requires;
- ask Visitors to upload identity documents, medical records or similar documents through forms or payment proof;
- use Records or subscriber lists in ways that break the law or the Privacy Policy, or sell or share them without the person’s consent; or
- publish recordings or images of people taken without their knowledge where the law requires consent.
11Regulated Goods and Services
Many businesses on Nichevio offer goods and services that are regulated, such as food, health and wellness services, professional advice, financial or legal services and age-restricted products. These are welcome when you follow the rules that apply to them.
You must hold any licence, registration or permit your business needs, display any information the law requires, and follow any age, location or other restrictions that apply to what you sell. Do not offer goods or services that are illegal where you offer them or where your customers are.
12Orders, Requests and Payments
If you take Orders, RFQs or booking requests through a Profile:
- describe your items, prices, charges, fulfilment and terms accurately, and honour what you publish;
- show only payment instructions that are accurate and that belong to you or your business;
- confirm a payment only after you have checked that you received it, and do not mark a payment as confirmed to mislead a customer;
- do not suggest that Nichevio processes, holds, guarantees or verifies payments made to you;
- do not present a booking request as a confirmed appointment until you have confirmed it; and
- do not ask for payment for an RFQ before you have sent a quotation that the customer has accepted.
If you submit an Order, a payment claim or payment proof, it must be genuine. Do not submit false or altered proof of payment.
13AI Media Assistant
Where the AI Media Assistant is offered, do not use it to:
- create images of real people, including yourself, your team or your customers;
- create logos, certificates, documents, testimonials or proof of payment;
- create images that misrepresent a product, dish, property or result, or present a generated image as a photograph of something you actually sell without making clear that it is illustrative where that matters;
- create anything this policy prohibits; or
- include other people’s personal information in your instructions.
Do not try to get around usage limits, moderation or the restrictions on which images the assistant can create.
14Abusive Automation and Interference
Do not:
- access or try to access Accounts, Workspaces, Records or systems you are not authorised to use;
- probe, scan or test the security of the Service without our written permission; if you find a security issue, tell us through the Contact page with Account or product support selected;
- use bots, scripts or other automated means to create Accounts or Profiles, submit forms, place Orders or collect information from the Service, beyond what ordinary search engine indexing of public pages involves;
- overload, disrupt or interfere with the Service, or get around rate limits, security checks or Plan limits;
- create multiple Accounts or Workspaces to get around limits, trial rules or enforcement action; or
- resell or provide access to the Service to others as your own service without our written agreement, other than managing Profiles for clients you represent.
15Custom Domains and Tracking
Where your Plan includes these features, connect only domains you control, and add only integrations Nichevio offers. Do not use them to collect information about Visitors without the notices and consent the law requires, or to redirect Visitors to deceptive pages.
16Reporting a Concern
If you see a Profile, Article or activity that may break this policy, tell us through Report Abuse. You do not need an account. Include the Profile address or link, what the problem is and, if you can, why you believe it breaks this policy. You can leave your email address if you are willing to be contacted for more information.
If someone is in immediate danger, contact the local emergency services or police first.
To protect everyone involved, we may not be able to tell you what action we took. We do not share a reporter’s identity with the Profile owner unless the law requires it or the reporter agrees.
17How We Review Reports
When we receive a report, or detect a possible problem ourselves, we look at the content or activity concerned and the surrounding circumstances, such as the Profile’s history and any related reports.
Where content or activity is causing active harm, we may limit or remove its public visibility while we review it. We keep the evidence we need for the review and do not keep unrelated personal information.
We decide what to do based on how serious the problem is, whether it appears intentional, whether it has happened before and the risk to Visitors and others.
18Enforcement
Depending on the problem, we may:
- ask you to change or remove content;
- remove content, or unpublish or limit the public visibility of a Profile or Article;
- turn off forms, ordering, payment instructions, the AI Media Assistant, custom domains or other features;
- change or reclaim a Profile address;
- restrict, suspend or close a Workspace or Account; and
- report the matter to the authorities where the law requires it or where there is a risk of serious harm.
Where it is appropriate and safe, we will tell the Profile owner what we have done and why. An action under this policy does not by itself entitle anyone to a refund; see the Refund Policy.
19Asking for a Review
If you believe we made a mistake, ask for a review through the Contact page, with Legal selected, or reply to our message about the decision. Explain why, and include any information that shows you own or represent the Profile or that the issue has been fixed.
We will look at the original evidence and your information again. Where we can, a different member of our team will review decisions with a significant impact. If the action was wrong, or the problem has been corrected, we will restore what we can.
20Changes to This Policy
We may update this policy as the Service, the law or the risks we see change. The version and date at the top of this page show which version applies.
