Nichevio Terms of Service

The agreement for using Nichevio: your Account, Workspaces, Profiles, content and the responsibilities that come with them.

1About These Terms

Nichevio is a service operated by Zealsync Private Limited (“Nichevio”, “we”, “us” or “our”). These Terms of Service (“Terms”) form an agreement between you and us about your use of the Nichevio website at nichevio.com, the Nichevio dashboard, public Profiles hosted by Nichevio and related features and emails (together, the “Service”).

You accept these Terms when you create an Account. When you sign up, we ask you to confirm that you agree to these Terms and to our Privacy Policy, and we record the time of that confirmation.

The following documents also apply and form part of your agreement with us: the Acceptable Use Policy; the Subscription Terms and the Refund Policy when you buy or trial a paid plan; and the terms of any custom-plan offer you accept. The Privacy Policy and the Cookie Policy explain how we handle personal information and the technologies we use.

If you use the Service on behalf of a business or another organisation, “you” includes that organisation.

2Definitions

These terms have the same meaning in every Nichevio policy:

Account
Your personal sign-in identity on Nichevio, based on your email address.
Workspace
The shared space where Profiles, team members, settings and billing are managed. Each Workspace has a Workspace Username, which is its dashboard address.
Owner
The Account that holds ownership of a Workspace. An Owner manages billing and team membership.
Team member
An Account invited to a Workspace with a role, such as Manager, Team member or Viewer.
Profile
A public mini-site on Nichevio, published at nichevio.com/your-profile-address or, where your plan allows it, at a custom domain.
Profile owner
The person or business that a Profile represents, acting through the Workspace that controls it.
Visitor
Anyone who views a Profile or interacts with it, for example by submitting a form or placing an Order.
Customer Content
Everything you or your team add to the Service, including text, images, prices, contact details and Articles.
Records
Submissions a Visitor makes through a Profile, such as inquiries, booking requests, quote requests, newsletter subscriptions, Orders and requests for quotation (RFQs).
Plan
The set of features and limits that applies to a Profile: Free, Starter, Pro or Growth in the Individual or Business family, or an approved custom plan.

3The Service

Nichevio lets you build and publish Profiles made of Widgets, collect Records from Visitors, publish Articles where your plan allows it and, on eligible Business plans, show menus and catalogs and receive Orders and RFQs.

Which features you can use depends on the Plan of each Profile. The current features and limits of each Plan are described on Pricing and in your dashboard. Some features are offered only in some places or only after they are enabled for your Workspace.

We may add, change or remove features. When a change materially reduces a paid feature you are using, we will try to tell you in advance through your dashboard or by email.

Features we describe as a preview or beta may change or end, and may not work as reliably as the rest of the Service.

4Eligibility and Authority

To create an Account you must be able to enter into a binding contract under the law that applies to you, and you must not be prohibited by law from using the Service.

Nichevio is a service for professionals, creators and businesses. It is not directed at children.

If you create an Account, a Workspace or a Profile for a business or another person, you confirm that you have their authority to do so and to accept these Terms on their behalf.

The information you give us when you sign up and when you set up a Workspace or Profile must be accurate, and you must keep it up to date.

5Your Account and Signing In

Nichevio does not use passwords. You sign in with a one-time code sent to your email address and, where it is offered for your Account, with Google or a passkey. If you have set up additional security, such as an authenticator app, you complete that step after the first one.

You are responsible for keeping access to your email account and your sign-in methods secure, and for activity that takes place through your Account. Never share a sign-in code with anyone. Nichevio will not ask you for one.

Tell us promptly through the Contact page, with Account or product support selected, if you believe someone has accessed your Account without permission.

We may ask you to verify your identity or your authority over a Workspace before we act on a request about it.

6Workspaces, Roles and Team Members

Each Workspace has an Owner. The Owner can invite team members, assign or change their roles, remove them, manage billing and transfer ownership. Roles decide what a team member can see and change. Some sensitive actions, such as viewing payment evidence or confirming a payment, require a separate permission in addition to a role.

The Owner is responsible for who has access to the Workspace and for the actions of its team members within it. Remove access promptly when someone should no longer have it.

A Workspace Username is the address of your dashboard. It is different from a Profile address, which is the public address of a Profile. Neither gives you ownership of a name, brand or trademark.

7Profiles and Public Publishing

You decide what to publish. When you publish a Profile or an Article, its content is available to anyone on the internet. It may be viewed, linked to, shared, copied by others and, where indexing is enabled, listed by search engines. Unpublishing a Profile removes it from public view; it does not delete it. Deleting content is a separate step, and how long deleted information may still be kept is explained in the Privacy Policy. We cannot recall copies that others have already made.

Profile addresses are subject to availability. Some words are reserved and cannot be used. We may decline, change or reclaim a Profile address where that is needed to comply with the law, to resolve a valid complaint about a name or trademark, to prevent confusion or impersonation, or to enforce the Acceptable Use Policy. Where it is appropriate, we will tell you before we do so.

Some Plans show Nichevio branding on your Profile.

Free Profiles that remain inactive may be shown in a reduced public form, as described in your dashboard, instead of being deleted.

8Your Content and the Permissions You Give Us

You keep all rights you have in your Customer Content. We do not claim ownership of it.

You give us a worldwide, non-exclusive, royalty-free permission to host, store, copy, process, adapt (for example, resize or optimise images), display and transmit your Customer Content, only as needed to provide, secure and support the Service, to follow your instructions, and to comply with the law. This permission lasts while your content is on the Service and for as long as we keep copies under the Privacy Policy, such as in backups or where the law requires us to keep them.

You confirm that you have the rights needed to publish your Customer Content, and that it does not infringe anyone else’s rights or break the law or the Acceptable Use Policy.

If you send us suggestions or feedback about Nichevio, we may use them to improve the Service without any obligation to you.

9Visitors, Records and Your Customers

When a Visitor submits a form, a booking request, a quote request, a newsletter subscription, an Order or an RFQ through your Profile, the Record is delivered to your Workspace. You decide how to use it, and you are responsible for that use.

If you collect personal information through your Profile, you must have a lawful reason to do so, give Visitors any information the law requires, keep the information secure, use it only for the purposes you collected it for, and respond to requests from Visitors about their information. Ask only for the information you need.

We process Records on your behalf to provide the Service, as described in the Privacy Policy. We may also use limited information from Records for our own purposes described there, such as security, preventing spam and abuse, and complying with the law.

A booking request is a request. It becomes an appointment only when you confirm it with the Visitor. Do not present a request as a confirmed booking.

You must not use Records to send messages that the recipient has not agreed to receive, or in any other way that breaks the Acceptable Use Policy.

10Orders, Quotes and Payments to Businesses

If you offer goods or services through your Profile, you are the seller. You are responsible for your listings, prices, availability, taxes, fulfilment, delivery, cancellations, returns, refunds, warranties and customer service, and for complying with the laws that apply to your business and your customers.

Nichevio is not a party to any sale, booking or agreement between you and a Visitor. Nichevio does not process, receive, hold, transfer or settle payments that Visitors make to you, and does not operate escrow.

On Plans that include ordering, an Order is saved before any payment instructions are shown or the Visitor continues to WhatsApp. If you show payment instructions, such as a UPI ID or bank details, they must be accurate and yours.

A Visitor can tell you that they have paid and can attach proof. That changes the Order’s payment status to awaiting your confirmation. It does not confirm that money was received. Only an authorised member of your team can confirm a payment, and only after you have checked it yourself.

WhatsApp is a way to communicate with a Visitor. It is not a payment method, and Nichevio cannot see whether a WhatsApp message was sent, delivered or read.

An RFQ is a request for a quotation. Submitting one does not create a payment obligation for the Visitor.

11Acceptable Use

You must use the Service lawfully and in line with the Acceptable Use Policy. Among other things, you must not use Nichevio for fraud, impersonation, phishing, spam, malware, exploitation, infringing others’ rights, misusing personal information, or interfering with the Service.

Anyone can tell us about content or activity that may break these rules through Report Abuse.

12AI Media Assistant

Where the AI Media Assistant is offered for your Plan, it can generate images for certain image slots, such as Profile covers, product and menu item images and Article covers. Usage is limited and depends on your Plan.

Generated images can be inaccurate. Review an image before you use it. Do not use generated images to mislead Visitors about what you sell, for example by showing a product or dish that differs from what a customer will receive.

The AI Media Assistant may not be used to create images of real people, logos, certificates, testimonials, proof of payment or other documents, or any content the Acceptable Use Policy prohibits.

13Third-Party Services

The Service works with services provided by other companies, for example Google sign-in, WhatsApp, maps links, payment apps used by your customers, the domain provider of a custom domain, and Dodo Payments for Nichevio subscription billing. Your use of those services is governed by their own terms and policies.

We are not responsible for third-party services or for websites that Profiles link to. A link does not mean that we endorse a service or website.

14Plans, Subscriptions and Fees

Free Plans are available without a subscription, within their limits. Paid Plans, the introductory trial and custom plans are governed by the Subscription Terms. Requests for refunds of subscription payments are handled under the Refund Policy.

The prices that apply to you are shown on Pricing and at checkout.

15Nichevio’s Rights

The Service, including its software, design, templates, Widgets, documentation and the Nichevio name and logo, belongs to us or our licensors and is protected by law. Except for your Customer Content, these Terms do not give you any rights in the Service other than the right to use it under these Terms.

You may use Nichevio templates and design elements as part of your Profiles on the Service. You must not copy, modify, sell or distribute the Service or its templates separately from it, reverse engineer it except where the law allows this, or use the Nichevio name or logo in a way that suggests we endorse you.

16Suspension and Termination

Ending your use of Nichevio

You can stop using the Service at any time. You can unpublish Profiles and, where your dashboard offers it, delete them. To close your Account or a Workspace you own, use the options in your dashboard where they are available, or send a request through the Contact page with Legal selected. To stop a paid Plan from renewing, cancel it as described in the Subscription Terms.

Action we may take

We may limit features, unpublish or remove content or Profiles, restrict a Workspace or suspend or close an Account if we reasonably believe that:

  • you have broken these Terms or the Acceptable Use Policy;
  • your use creates a risk of harm to Visitors, other customers, Nichevio or the public;
  • we are required to do so by law or by a lawful request from an authority; or
  • a payment for a paid Plan has not been made, as described in the Subscription Terms.

Our action will be proportionate to the problem. Where it is appropriate and lawful, we will tell you what we have done and why, and give you a chance to respond or fix the issue. Where there is active harm, we may act first and review afterwards. You can ask us to review a decision as described in the Acceptable Use Policy.

What happens next

When a Profile is unpublished, suspended or removed, it is no longer publicly available and its forms and ordering stop accepting submissions. When an Account or Workspace is closed, access ends. Records and other information are then kept or deleted as described in the Privacy Policy. If your Plan includes exporting Records, export anything you need before you close a Workspace.

Sections of these Terms that by their nature should continue after termination, including those on your content, payments to businesses, responsibility and disputes, continue to apply.

17Availability of the Service

We work to keep the Service available and secure, but we do not promise that it will be uninterrupted, error-free or available at all times. We may need to pause parts of it for maintenance, security or reasons outside our control.

Keep your own copies of content that is important to you.

18Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, and we do not make promises about it beyond those stated in these Terms and the policies they refer to.

We do not verify the identity of Profile owners, the accuracy of what they publish, or the quality, safety or legality of what they offer. A Profile on Nichevio does not mean we endorse it.

Nothing in these Terms excludes or limits any right you have under consumer protection or other law that cannot be excluded or limited.

19Responsibility for Loss

Nichevio is not responsible for:

  • the content, goods, services, bookings, payments or conduct of Profile owners or Visitors, or any dealings between them;
  • services and websites provided by third parties;
  • loss caused by someone using your sign-in methods because they were not kept secure; or
  • delay or failure caused by events beyond our reasonable control.

You are responsible for claims that arise from your Customer Content, from your use of Records and from your dealings with your customers.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

20Questions, Complaints and Disputes

If you have a concern about the Service or about these Terms, contact us first through the Contact page, with Legal selected as the inquiry type, so that we can try to resolve it.

A complaint about a purchase from a business using Nichevio should be raised with that business. If you think a Profile is breaking the Acceptable Use Policy, use Report Abuse.

These Terms do not take away any right you have under the law of the place where you live to bring a claim before a court or authority there.

21Changes to These Terms

We may update these Terms when the Service, the law or our practices change. The version and date at the top of this page show which version applies.

When a change is material, we will tell Owners by email or in the dashboard before it takes effect. If you do not agree with a change, you can stop using the Service and cancel any paid Plan before the change applies. If you continue to use the Service after the change takes effect, the updated Terms apply.

22General

These Terms, together with the documents they refer to, are the entire agreement between you and us about the Service and replace any earlier agreement about it.

If a court or authority finds part of these Terms unenforceable, the rest continues to apply. If we do not enforce a right straight away, we have not given it up.

You may not transfer your rights under these Terms without our written agreement. We may transfer our rights and obligations to another company as part of a reorganisation, merger or sale of the business that operates Nichevio, and we will tell you if that happens.

We will send notices about your Account or Workspace to the email address on your Account. These Terms are written in English.
